Dispute Resolution is simply a term used to describe the process of resolving a dispute between conflicting parties. The process of finding a resolution is typically a legal one, however at times a commercially minded accountant can be engaged to help quantify a position to help reach a settlement.
We have a breadth of technical expertise which provides us with the foundations from which we provide our services.
These foundations alone will not achieve the desired outcome and must be complemented with commercial awareness, empathy and in some cases innovation.
At RFA we understand that there may be no winners and it can be an achievement to avoid any party leaving the negotiations feeling bitter or hard done by.
A family dispute was resolved through mediation. RFA presented proposals and supported our client to reach a resolution. We provided business valuation, applications for finance and advice on deal structure. Moreover our attendance at mediation helped the client remain calm, focused and objective. Ultimately a deal was reached without further legal recourse.
We are experts in the practical application of Insolvency law and have strong commercial awareness. In a recent case we have presented proposals to a Liquidator to ensure assignment of debt to a former Director.
RFA acted as expert witness in a long running dispute between Bank and Customer. Providing an expert opinion and attending mediation, the case was settled some 10 years after it commenced.
We provided a valuation of equity in a farm divorce. A complex assessment to identify if the farm was solvent or insolvent helped our client progress negotiations.
Negotiations between Trustees and a Bankrupts spouse can often break down. Acting as an intermediary, we have presented arguments and negotiated on behalf of numerous spouses, particularly in respect of equity in the Private Dwelling House.
